A long and complex litigation regarding the cadastral value of a portion of the underground complex of Villa Borghese in Rome has been successfully concluded.

A long and complex litigation regarding the cadastral value of a portion of the underground complex of Villa Borghese in Rome has been successfully concluded. The dispute concerned the rental values for certain areas used for medical, aesthetic, and sporting activities, which had been adjusted by the Tax Office using a "comparative" method based on other structures in the same urban zone. This initial assessment failed to account for the specific logistical and structural characteristics of the property, such as its underground location and limited accessibility.

Following a phase before the Supreme Court, which established that the appraisal should be verified based on the "depreciated replacement cost" rather than a comparative metric, the merit judges appointed a technical expert (CTU). The judges ultimately recognised the arguments for the property, redetermining the values based on the specific nature of the real estate asset and resulting in a reduction of approximately 70% compared to the values originally claimed by the Tax Office.
