Silva Advises on Smiley's Registration in Chile


Silva, a Chilean law firm with more than 25 years of experience, successfully advised The Smiley Company, one of the top 100 licensing companies in the world, in the registration process of the brand in Chile.


The company has faced two main problems during the process. The first one when Authorities of the National Institute of Industrial Property (INAPI) issued an initial office action against the trademark application, rejecting its registration in class 32 because it contained a visual and phonetic similarity with "Cardio Smile" trademark, belonging to the company Nutrartis S.A.  The second one, an opposition action by Smiles S.A., for its registration application in class 35, related to business management services, consulting and advertising, among others things.


This case was led by lawyer Juan Pablo Silva, founder and partner of Silva Abogados, who appealed the decision in first instance to the Industrial Property Court (TDPI) and granted the registration on behalf of Smiley in both classes.
