Iberdrola partners with 14 Spanish law firms in an unprecedented pro bono initiative
The project’s commitment to society, “Building Together,” will offer legal services, tax advice and training to social organizations free of charge.
IDB Invest, the private sector investment arm of the Inter-American Development Bank, has provided financing for Chile of up to $1.8 billion to mitigate the impact on energy generation companies resulting from deferred payments established by Law No. 21.472, known as the MPC Law.
The MPC Law stabilizes energy rates for regulated customers, mainly residential and small businesses, and establishes a deferral of payments to generating companies backed by the issuance of payment documents charged to the tariff stabilization fund (FET) created by said law.
Through the financing facility, IDB Invest will acquire all eligible payment documents from said fund.
The financing facility includes the issuance of bonds.
IDB Invest was counselled on the issuance by Chilean law firm Guerrero Olivos’ energy and public law teams.
The lawyers involved were in charge of the regulatory analysis of the operation, through a due diligence process, the issuance of a regulatory report, documents related to the transaction's implementation of the stabilization mechanism, and review of compliance matters.
Likewise, the firm’s capital markets and financing team were responsible for negotiating and drafting the contracts to structure the financing facility and to carry out the acquisition of the payment documents.
The firm’s core team was led by leading partner Clemente Pérez, with partners Miguel Coddou, Felipe Fruhling, Alejandro Chechilnitzky and José Gabriel Undurraga.
