Brescia Court Confirms Mille Miglia Museum’s Right to Use Trademark in 2025

The Mille Miglia Museum obtained a favorable decision in a preliminary injunction proceeding filed by the Automobile Club of Brescia (together with 1000 Miglia S.r.l.), which sought the immediate suspension of the Museum’s use of the “Mille Miglia” trademarks following AC Brescia’s withdrawal from the namesake association at the end of December 2024.
The Museum has been using the “Mille Miglia” trademarks since 1996 under a license granted by AC Brescia at the time the association was founded. However, since last December, the Museum’s right to continue using the trademarks of the “corsa più bella del mondo” (freely translated as “the most beautiful race in the world”) had been called into question due to AC Brescia’s withdrawal from the association.
The Court of Brescia — accepting the Museum’s arguments in an order issued on 4 June 2025 (subject to appeal) — ruled that AC Brescia’s withdrawal from the association is currently ineffective and, consequently, the termination of the trademark license cannot stand. The Court found that the withdrawal was not carried out in accordance with the applicable legal procedures and deadlines, thereby confirming the legitimacy of the Museum’s continued use of the “Mille Miglia” trademarks.
