German State of Baden-Württemberg Wins Landmark Ruling in €7 Billion Stuttgart 21 Dispute with Deutsche Bahn

In a high-stakes decision that brings an end to a nearly decade-long legal battle, the German State of Baden-Württemberg has prevailed against a €7 billion claim brought by Deutsche Bahn over the controversial Stuttgart 21 rail project.

The ruling — handed down by the Administrative Court of Appeal of Baden-Württemberg — solidifies a 2024 lower court judgment, dismissing Deutsche Bahn’s attempt to hold the state liable for spiralling costs tied to the delayed rail infrastructure megaproject. The appeal was backed by WilmerHale, representing the German national railway and its subsidiaries.

The White & Case team, led by public commercial law partner Henning Berger in Berlin and corporate partner Julia Sitter in Frankfurt, secured a definitive legal victory for the state, with the court concluding that Baden-Württemberg bears no responsibility for the cost overruns.

"At no point did the State of Baden-Württemberg assume any obligation to cover the cost overruns of the Stuttgart 21 project," said Berger.
"The state only made specific financial contributions under public subsidy law, as clearly and unambiguously defined in the financing agreement."

A symbol of costly infrastructure delays

Launched more than 20 years ago, Stuttgart 21 was envisioned as a transformative hub integrating regional, intercity, and local transit via a semi-underground station in the city’s center. Initially projected to cost €4.5 billion, its budget has ballooned to nearly €12 billion, drawing comparisons to other over-budget infrastructure projects like the UK’s HS2 and California’s “train to nowhere.”

The now legally binding ruling ends the litigation that has spanned administrative courts since 2016. According to the court, Deutsche Bahn’s arguments did not justify appeal admissibility and failed to demonstrate any substantive legal or procedural errors.

A spokesperson for Deutsche Bahn said the company “regrets” the decision and is reviewing its legal implications, reiterating its belief that the state was a financial stakeholder in the project’s full cost.

The Stuttgart 21 judgment strengthens White & Case’s profile in German public infrastructure disputes, particularly in the intersection of state liability, subsidy law, and complex multi-party financing arrangements. The win also affirms the state's contractual and legal position, shielding taxpayers from one of the largest public infrastructure claims in Germany’s recent legal history.

“This brings to a legally binding end a legal dispute that has been pending before administrative courts since 2016,” Berger added. “Deutsche Bahn has no further ordinary legal remedies against the court’s decision.”
