TAR Lazio rejects Iliad's appeal against AGCM decision not to investigate Poste Italiane's acquisition of TIM

The TAR Lazio (Regional Administrative Court) has rejected the appeal brought by Iliad against the decision of the Autorità Garante della Concorrenza e del Mercato (AGCM), the Italian Competition Authority, which in September 2025 had decided not to open a formal investigation into Poste Italiane's acquisition of exclusive control of TIM.
In its ruling, the Court held that the AGCM's decision was the result of an adequately reasoned technical assessment, with no elements of unreasonableness or errors such as to justify judicial intervention. According to the Court, the Authority correctly exercised its discretionary power in assessing the effects of the transaction.
Poste Italiane was assisted by BonelliErede, with a team led by partner Claudio Tesauro and comprising senior counsel Pasquale Leone. Partner Raffaele Cassano handled administrative law matters.
TIM was assisted by Dentons, with a team led by partner Michele Carpagnano, Head of the Competition and Antitrust department in Italy, and comprising counsel Giulia Giordano, as well as partner Ilaria Gobbato for administrative law matters. TIM's internal legal team, led by General Counsel Agostino Nuzzolo, also took part in the matter.
