Silva, through its partners Francisco Silva and Ricardo Montero, advised California Pizza Kitchen (CPK), on the registration of its brand before the Chilean Industrial Property Authority, after a 15-year trademark dispute.
Established in 1985, CPK, a California-based restaurant chain, has more than 250 locations on 11 countries.
In 2016, CPK expanded to Chile and ever since, the food chain had multiple oppositions from other companies. In first instance, the brand was rejected, based on the previous registration of the brand California of the Peruvian food giant, Gloria S.A. Then, another issue popped up when the Chilean National Institute of Industrial Property rejected CPK trademark, due to the previous registration of the pastry shop California.
Finally, in 2018 the Industrial Property Court ruled that California Pizza Kitchen was distinguishable from other brands , since the words “pizza” and “kitchen” contained in its name, helped to avoid confusion, error or deception regarding the origin and quality of the products granted, dismissing Gloria’s claim.
